New legal proceedings issued in the UK which are required to be served on the Treasury Solicitor can be served as follows:
1. All new proceeding save for immigration proceedings and costs claims in immigration proceedings.
By email to newproceedings@governmentlegal.gov.uk for all new legal proceedings except for new immigration proceedings and costs claims in immigration proceedings as to which see 2 below. GLD would be grateful if, where possible, all new proceedings were served electronically and hard copy documents are not also sent to our postal address.
If you are aware that a GLD case officer has been dealing with the matter, for example at the pre-action stage, please copy them in to the email to the new proceedings email address. Service will only be valid however if effected by emailing the new proceedings email address.
Once new proceedings have been validly served, all subsequent service within those proceedings of documents, should be effected on the currently allocated GLD case officer by email to their GLD email address unless the parties to the proceedings are informed of other arrangements.
2. All new immigration proceedings and costs claims in all immigration proceedings including in upper tribunal judicial reviews.
By email to ImmigrationAdminTeam@governmentlegal.gov.uk for all new immigration proceedings and service of formal costs claims on the Home Office (SSHD) in immigration proceedings namely:
• Immigration High Court judicial reviews (Upper Tribunal immigration judicial reviews should be served on the Home Office at 6 New Square, Bedfont Lakes, TW14 8HA or by email at UKVIJudicialReview@homeoffice.gov.uk)
• Immigration habeas corpus applications
• Immigration family court proceedings
• Appeals to the Court of Appeal challenging Immigration Upper Tribunal Appeal decisions
Again, if you are aware a GLD case officer has already been dealing with the matter please copy them into the email ImmigrationAdminTeam@governmentlegal.gov.uk.
As with service of other proceedings, once new immigration proceedings have been served, whether on GLD for the Treasury Solicitor or the Home Office, subsequent service within those proceedings should be effected on the currently allocated GLD case officer by email to their GLD email address.
The reference to service of cost claims above is to formally served claims for costs (Notice of Commencement and Bill) against the Home Office (SSHD) pursuant to costs orders made in the above listed types of proceedings and in Immigration Upper Tribunal judicial review proceedings. This does not include informal claims for costs or correspondence relating to costs which should be directed to the GLD case officer. Where the GLD case officer is known to the party serving formal costs proceedings the GLD case officer should also be copied in to the email.
Please note:
The email addresses above are for the service of new proceedings only.
They should not be used for letters before action, or pre action protocol correspondence. If sending such documents to GLD please email these to thetreasurysolicitor@governmentlegal.gov.uk.
As per the foregoing for all proceedings (including in the Supreme Court) once a GLD case officer has been allocated to the proceedings all subsequent service in those proceedings, save for formal costs claims in Immigration proceedings (see above), should be effected on their, or any nominated successor's, GLD email address. If you have not been notified of a GLD case officer please contact the litigation enquiries number above.
Where proceedings have been served by email please do not send hard copy duplicates of any documents.
