Special Educational Needs - Children and Families Act 2014 - recommendations as to social care needs and provision - separated parents of 9 year old child with Education, Health and Care (EHC) plan - First-tier Tribunal (FTT) decided that mother alone to decide what social care activities child would take part in - father had asked to be involved - were FTT’s reasons for rejecting father’s case adequate? Held: No - decision erred in law - However, decision not set aside as EHC plan in question had been superseded by new EHC plan, so remitting case back to the FTT for reconsideration would be academic - Appeal thus allowed in part
