Judicial Summary

The required period and the required period condition both contain two periods – a retrospective period and a prospective period. Each must be satisfied before an award can be made. They do not consist of a single 12 month period.

Advance award. This is only possible if the decision-maker or tribunal has made findings of fact to show that, barring any change in circumstances, within three months the claimant will have satisfied the 50% of the time rule leading to sufficient points to allow an award.
