Judicial Summary

Appellant placed on children’s barred list by Disclosure and Barring Service (DBS) - Appellant had been prosecuted on multiple charges of historic sexual abuse, namely rape against his ex-wife and sexual assaults on his children, resulting in two hung juries before prosecutions discontinued - Eldest daughter gave evidence to Upper Tribunal, stating that stories had been fabricated by her mother, and so retracting the daughter’s earlier evidence to the police - Credibility of witness - Upper Tribunal concluded no material mistake of fact by DBS and so dismissed the appeal.
