Judicial Summary

The First-tier Tribunal erred in law (i) in failing to take account of the medical records entries that pre-dated the Road Traffic Accident and showed back pain, and (ii) in failing to explain why, despite those entries, the back pain was not from the domestic violence. This case turned on its facts. But it is being published at the First-tier Tribunal’s request because of the point about medical records.
