(1) Where a Traffic Commissioner’s refusal to grant a ‘period of grace’ is integral to the Commissioner’s decision to revoke an operator’s licence, the Commissioner’s reasons must provide some explanation as to why a period of grace was refused. (2) The Office of the Traffic Commissioner’s (OTC) misleadingly restrictive description of the purpose of a public inquiry, given when informing an operator, in a Proposal to Revoke letter / notice under section 27(2) of the Goods Vehicles (Licensing of Operators) Act 1995, of its right to request an inquiry, rendered the Traffic Commissioner’s subsequent decision to revoke the operator’s licence procedurally unfair.
