Judicial Summary
(1) Where a Traffic Commissioner’s refusal to grant a ‘period of grace’ is integral to the Commissioner’s decision to revoke an operator’s licence, the Commissioner’s reasons must provide some explanation as to why a period of grace was refused. (2) The OTC’s misleadingly restrictive description of the purpose of a public inquiry, given when informing an operator, in a Proposal to Revoke letter, of its right to request an inquiry, rendered the Traffic Commissioner’s subsequent decision to revoke the operator’s licence procedurally unfair.
