Judicial Summary

Appellant’s application for costs under Rule 10(3)(d) dismissed. Applying the judgment of Lane J in Thapa v Entry Clearance Officer [2018] UKUT 54 (IAC) the award of costs under Rule 10 of the Upper Tribunal Rules 2008 is to be exercised with significant restraint. The Disclosure and Barring Service did not act unreasonably on the facts of the case.
