Judicial Summary

This decision decides that the rule in universal credit that only one of the two separated parents may receive a housings costs element in respect of the child for whom the separated parents are providing exactly equal shared care: (a) has not been shown to be indirectly discriminatory under article 14 of the European Convention on Human Rights (ECHR) against male parents in such a situation, and (b) in any event, any such discrimination is justified. It also comments on whether the First-tier Tribunal ought to have granted permission to appeal or have left that decision to the Upper Tribunal.
