Judicial Summary

The parent with care sought a variation in response to an appeal against a child maintenance assessment by the non resident parent. The First-tier Tribunal had not had power to direct the Secretary of State to make a decision under the Child Support Act 1991 but its direction could be treated as an invitation to the Secretary of State to consider the issue. The tribunal had jurisdiction to consider the variation as a matter raised in the appeal.
