.Judicial Summary
The appellant was the holder of a restricted licence who had been convicted of various offences including assault by beating following an altercation with another driver. He had also committed breaches of the drivers’ hours and tachographs rules. The Traffic Commissioner concluded that he did not satisfy the requirement of fitness, revoked the licence and disqualified the appellant for a year. The Upper Tribunal considered the applicability of Redsky in such circumstances and concluded that the decision was not plainly wrong.
