Judicial Summary
(1) Failure to draw relevant evidence to the Traffic Commissioner’s attention meant that the Commissioner’s decision involved an error of law. (2) The Traffic Commissioner is not a party to an appeal made to the Upper Tribunal against the Commissioner’s decision. This means that the Upper Tribunal has no power to make a costs order against the Commissioner.
