Judicial Summary

There is no right of appeal to the Upper Tribunal against a Traffic Commissioner’s decision, taken under section 16(4) of the Goods Vehicles (Licensing of Operators) Act 1995, to refuse to accept an operator’s request to terminate (surrender) its licence. However, the Upper Tribunal expressed the obiter view that the lawfulness of such decisions might legitimately arise for determination on an appeal against a Commissioner’s decision, taken after refusing a surrender request, to revoke an operator’s licence.
