Judicial Summary

It is important for the First-tier Tribunal to consider the totality of the evidence in a holistic manner, make sufficient findings of fact to resolve conflicts in the evidence and state which evidence it prefers and why, in its written reasons. Observations made on the day of hearing should be considered carefully given this will usually be some months after the date of decision and consideration should be given to whether, in the interests of natural justice, the claimant should be afforded the opportunity to comment on these observations particularly when they are material to the Tribunals findings of fact.
