Judicial Summary

The First-tier Tribunal made a number of errors of law in its determination of the appellant’s entitlement to Personal Independence Payment, including: (i) by using information on a website to assist in its assessment of the extent of the appellant’s visual difficulties without giving the appellant an opportunity to comment on that; and (ii) perversely concluding that the appellant could carry out certain activities of daily living safely because she had not had any recent accidents when the evidence was that she had not been undertaking those activities to more than a minimal extent.
