Judicial Summary

The appeal is dismissed. The Department for Infrastructure for Northern Ireland was entitled to revoke the Appellant’s application to vary his operator’s licence, as the requirements of suitability and availability of the proposed new operating centre were not met. Consequently, the decision was not “plainly wrong”.
