Judicial Summary

(1) (obiter) the formal role of a psychiatrist or clinical psychologist in determining disabling mental injury claims under the Criminal Injuries Compensation Scheme 2012 is confined to confirming a disabling mental injury, rather than its likely duration; (2) Scots law terms, such as ‘adminicle’, should not be used in submissions for a case decided under the law of England and Wales.
