Judicial Summary
The Social Security (Payments on Account, Overpayments and Recovery) Regulations 1988 did not operate to treat Carers Allowance (CA) paid to the appellant’s carer to be offset against payments of Employment and Support Allowance (ESA) where both CA and ESA had been paid in full to the carer in respect of the same period. The carer had been entitled to and in receipt of CA so that the appellant was not entitled to the Severe Disability Premium.
