Judicial Summary

Propose to Revoke letter sent upon basis that the operating centre was no longer suitable; the Appellant no longer had an effective and stable establishment; and material change since the granting of the licence by reason of the operating centre having become unsuitable. There had been no material change as the operating centre had always been unsuitable. The licence should not have been granted in the first instance. Inadequate reasons given for proposal to revoke and for revocation and there had been errors in approach. Appellant responded to the Propose to Revoke letter. Issue of whether the wording of response amounted to a request for a public inquiry. Matter remitted for outstanding variation application to be considered.
