Asylum Support Tribunal decision of Judge Carter on 18 July 2014.

Discontinuance of Section 4 support - the appellant’s epilepsy did not render him unable to depart the UK either by escorted air travel or by an overland journey. Detailed evidence from the escort team as to the support, medication and supervision that could be provided. Appellant’s GP did not rule out escorted air travel and commented on non-compliance with prescribed medication. No evidence of other medical problems asserted by the appellant. Regulation 3(2)(b) test not met. Regulation 3(2)(e) not engaged - although epilepsy worsened by stress, this can be avoided by compliance with medication and taking steps to leave the UK.
