Asylum Support Tribunal decision of Judge Verity Smith on 20 December 2007.

Jurisdiction considered. Section 9 of the Asylum and Immigration (Treatment of Claimants etc) Act 2004 states that there is no right of appeal to the Tribunal against decisions to refuse to support on the grounds that an applicant is an EEA national. The appellant was Romanian and thus a citizen of an EU state listed as ineligible for support under Schedule 3 of the Nationality, Immigration and Asylum Act 2002.
No jurisdiction to hear the appeal.
