Asylum Support Tribunal decision of Judge Verity Smith on 15 February 2008.

Refusal of support under Section 4(1)(c). The appellant’s argument that his status as a foreign national offender on immigration bail superseded his status as a failed asylum seeker did not succeed. Failed asylum seekers fall to be considered for support under Section 4(2) and must satisfy the Regulation 3(2) eligibility criteria, which this appellant did by virtue of an outstanding immigration appeal.
