Asylum Support Tribunal decision of Judge Verity Smith on 3 January 2012.
The appellant’s support was discontinued under Regulation 3(2)(e) by way of the final rejection of his further representations in relation to his claim to asylum. Regulation 3(2)(b) was raised in terms of the appellant’s wife’s pregnancy which although less than 34 weeks (the cut off for flying in pregnancy) was beset by complications including poor mental health. Finding that Regulation 3(2)(b) applied by application of the respondent’s Section 4 instructions regarding complications in pregnancy.
