On the basis of the information available to it, the Office of Fair Trading has decided that the completed acquisition by Scottish and Southern Energy plc of an additional 8.36% stake in Barking Power Ltd does not qualify for investigation under the merger provisions of the Enterprise Act 2002 (the Act), because there is no change in the level of control. A relevant merger situation has, therefore, not been created.
