Intra-company Transfers: call for evidence
Detail of outcome
The findings from this consultation are in the Review of the Intra-company Transfer (ICT) route 2021.
Original call for evidence
Call for evidence description
In September 2020, the Migration Advisory Committee (MAC) were commissioned by the government to undertake a study of the Intra-Company Transfer (ICT) immigration route to advise on the operation and effectiveness of that route.
The ICT route currently sits alongside the Skilled Worker route for skilled workers in the current immigration route. This route is designed to enable employers in the UK to easily move existing senior employees and specialists who have been employed by the company for at least 12 months from overseas offices to roles in the UK.
The ICT route has different salary thresholds and requirements than the Skilled Worker route. The MAC have been asked to advise on the points below:
- the salary threshold for entry to the ICT route
- what elements, if any beyond base salary should count towards meeting the salary requirement
- whether, as now, different arrangements should apply to the very highly paid
- what the skills threshold for the route should be
- the conditions of the route, in particular those where it differs from the main Tier 2 (General)/Skilled Worker route
The government are also seeking to expand its mobility offer to enable overseas businesses to send teams of workers to establish a branch/subsidiary (currently we can only admit a single worker for this purpose) or to undertake a secondment in relation to a high-value contract for goods or services.
The MAC have also been asked in addition to the above to consider:
- criteria on the eligibility of workers (for example, skill and salary threshold)
- criteria on sending organisations (for example, size of company, value of investment or contract, potential job creation)
The MAC are due to report back to the government in October 2021.
Call for evidence
The MAC call for evidence on ICTs is seeking views and evidence from anyone with relevant knowledge, expertise or experience to help inform the MAC response. We welcome views from interested parties from all parts of the UK. The evidence provided will form a crucial component of the MAC’s response to the government.
We have developed the questionnaire to cover key ground in a consistent manner for this call for evidence. However, we also welcome the additional upload of documents and evidence, which can be attached and submitted at the end of the questionnaire.
Responses should be evidence-based and where possible should provide data and/or examples to support your answers.
The deadline for submitting your responses to the call for evidence questionnaire is 22 June 2021.
