Detail of outcome
The CMA has now published its final compliance advice for businesses marketing green heating and insulation products to help them to understand and comply with their existing obligations under consumer law.
Alongside the compliance advice, the CMA has also published some short videos and checklists for businesses summarising the principles which are designed to help them comply with the law.
Original consultation
Consultation description
The purpose of the compliance advice is to help relevant businesses to understand and comply with their existing obligations under consumer protection law when marketing green heating and insulation products for use in the home.
The CMA has produced this draft compliance advice following concerns we identified about some businesses in the sector making potentially misleading claims about green heating and insulation products and/or providing limited and inconsistent upfront price information, as part of our review of consumer protection in the sector.
The CMA invites interested parties to respond in writing to the questions set out in Section 3 of the consultation document no later than 5pm on 24 January 2024. The consultation will be of interest to:
- all businesses which market, sell, design, install, service or maintain green heating and/or insulation products for UK consumers to use in their home. This includes lead generation companies and marketing firms that advertise green heating and/or insulation products to consumers on behalf of other businesses
- trade bodies and other representative bodies of businesses in the sector
- standards bodies which set and/or monitor business compliance with quality and consumer protection standards in this sector including certification schemes, registration schemes and approved Consumer Codes
- consumer advisers and consumer representative bodies and charities
- fellow enforcers of consumer protection law (including local authority Trading Standards Services), regulators and government departments
Please email your response to greenheating@cma.gov.uk no later than 5pm on 24 January 2024. You can also contact us with any queries regarding the consultation using this email address.
The CMA plans to publish the final version of its compliance advice and an anonymised summary of the responses that fall within the scope of the consultation (which will contain a list of respondents other than individuals) in the spring of 2024.
