Draft legislation: The Value Added Tax (Refund of Tax) Order 2019

We want your views on draft legislation that will add 4 public bodies to a special refund scheme that allows named public bodies to receive a refund of some or all of their VAT relating to their publicly funded non-business activities.
The 4 bodies

The East West Railway Company (EWRC) is a non-departmental public arm’s length body set up by the government to accelerate the East West Rail project – a new rail link between Cambridge and Oxford.

High Speed Two (HS2) Ltd is a company responsible for delivering the new high-speed rail network linking London to Birmingham and the north of England. It is a Department for Transport executive non-departmental public body (NDPB).

The Transport for Wales (TfW) is wholly owned by the Welsh Government and a not-for-profit company limited by guarantee responsible for the promotion and delivery of transport infrastructure and related services on behalf of the Welsh Government.

The Single Financial Guidance Body (SFGB) is a NDPB which replaces the 3 existing providers of government-sponsored financial guidance: the Money Advice Service, the Pensions Advisory Service and Pension Wise, bringing together the provision of debt advice, money guidance and pension guidance for the first time. The new body will deliver free and impartial financial guidance and a more streamlined service to members of the public providing easier access to the information and guidance.
The legislation will name these bodies as entitled to refunds under s33E of the 1994 VAT Act, entitling them to a refund of VAT incurred on their non-business activities, to the extent directed by HM Treasury.
