Detail of outcome

This is the government response to the ‘Consultation on draft regulations for the McCloud remedy’. The consultation was published on 16 December 2022 and closed on 10 February 2023 and sought comments on the technical regulations required to implement the McCloud remedy. A total of 10 replies were received which were broadly in support of the approach in the regulations. These replies are summarised in this consultation response along with the amendments made.

Consultation description

In the case of McCloud v MOJ, the Court of Appeal held that transitional protections provided to older judges as part of the 2015 judicial pension reforms constituted unlawful direct age discrimination. MOJ is committed to addressing the discrimination for all affected judges.

Following the Public Service Pensions and Judicial Offices Act 2022, MOJ is now consulting on technical regulations to deliver aspects of the McCloud remedy.
