In July 2021, the Ministry of Justice published a consultation setting out the draft regulations for a reformed judicial pension scheme, the Judicial Pension Scheme 2022.
The majority of responses we received welcomed the progress being made on the scheme, particularly that judges will be returned to a tax-unregistered scheme. We received a small number of concerns which are addressed in our response. Save for some technical amendments, we propose to implement the regulations as set out in the consultation document.
We have also updated the equality statement for these reforms.
Subject to the necessary parliamentary approval, the new scheme will come into effect from 1 April 2022.

In July 2020, the government published a consultation on ‘Proposals for a reformed judicial pension scheme’ which outlined proposals to reform the judicial pension arrangements. It set out the features of the reformed pension scheme and how it would deliver on the government’s commitment to develop a pensions-based solution to address the recruitment and retention issues within the judiciary.
In February 2021, the government published its response to the consultation which outlined that the Government would implement the reformed scheme in line with the proposals set out in the consultation document, published in July 2020.
The reformed judicial pension scheme - the Judicial Pension Scheme 2022 will be made in secondary legislation under the existing power in section 1 of Public Service Act (PSPA) 2013. Further amendments are required to the PSPA 2013 in order to implement the scheme. These changes are contained within the Public Service Pensions and Judicial Offices Bill, which is currently being scrutinised by Parliament.
This consultation sets out the draft scheme regulations for the Judicial Pension Scheme 2022 which contain the detailed rules and features of the scheme. The government welcomes views on the proposals outlined in this publication.
