Following consideration of the responses, the government has confirmed the steps it will be taking to resolve the McCloud age discrimination in respect of the Local Government Pension Scheme (England and Wales).

Powers to implement this approach were contained in the Public Service Pensions and Judicial Offices Act 2022, which received Royal Assent in March 2022.

Consultation description

This consultation seeks views on changes to the Local Government Pension Scheme in England and Wales (LGPS). Following a consultation we undertook in 2020 on proposals to address discrimination found by the courts in the ‘McCloud’ case, we published a government response in April 2023 setting out how we would proceed. We are now seeking views on issues relating to the McCloud remedy, where a) we stated in the government response we would be reconsulting to obtain further views, or b) our initial consultation did not address the issue. We are also seeking views on draft scheme regulations (at annex A) which would implement the remedy.
