Mobile homes: a fit and proper person test for park home sites
Applies to England

Detail of outcome
In 2018, the government gave a commitment to introduce a fit and proper test, subject to a technical consultation, to help local authorities target the worst offenders in the sector. The consultation was carried out between 25 July and 17 September 2019 and received 370 responses which were largely in favour of the proposals.
The government’s response sets out proposals which will require all site licence holders to apply either on behalf of themselves or their appointed site manager to the relevant local authority for inclusion on a fit and proper person register. The local authority will consider a set of criteria – the “fit and proper person test” and will either grant an application unconditionally, grant it subject to conditions, or reject it. If a site licence holder or site manager fails the test, the site licence holder would have to appoint a new manager (who must be a fit and proper person) themselves, or consent to the local authority doing so.
Applicants will be included on the register for a period of up to 5 years.
A local authority may vary or reject a condition attached to an entry on a register.
It will be an offence to breach a condition attached to an entry, provide false or misleading information in support of an application, or to operate a site without having a fit and proper person in place. If convicted of any of these offences, the site owner will be liable for an unlimited fine. Breach of these requirements will also enable the local authority to apply to court to have the site licence revoked.

Consultation description
In 2018, following a review of park homes legislation, the government gave a commitment to introduce a fit and proper person test for site licence holders and managers of park home sites in England, subject to a technical consultation. The purpose of the test is to improve the standards of park home site management.
This consultation is intended to ensure that the regulations will support effective operation of the fit and proper person test in practice.
