Summary

The Proceeds of Crime Act 2002 has been amended by the Policing and Crime Act 2009 and the Crime and Courts Act 2013. This consultation is on new and revised codes of practice that govern the use of some of the powers in the act.

Consultation description

The Proceeds of Crime Act 2002 provides for a statutory consultation on new codes of practice and on any amendments to existing codes. The codes will then be subject to parliamentary approval before coming into force.

There are 4 separate codes of practice on which we seek views. Two codes provide guidance about exercising the new powers to search and seize and detain property. One of these relates to England and Wales, the other to Northern Ireland. A third code provides guidance on the operation of the powers to search for criminal cash, updated to include the new power to search vehicles. A fourth code provides guidance on the operation of the investigation powers.
