In November 2020, the Department for Transport (DfT) commissioned the Office of Rail and Road (ORR) to undertake a stakeholder survey about the impact and effectiveness of the Railways and Other Guided Transport Systems (safety) Regulations 2006 (as amended) (ROGS).
Directive 2004/49/EC (the Directive) established a common framework for the regulation and development of railway safety across all European Union member states.
The ROGS transposed the principal part of the Directive in Great Britain and also contain provisions covering other railway safety requirements.
They have been updated and amended over time to reflect changes in EU law.
The outcome sets out the findings of the latest post-implementation review of ROGS. The review was the first to take place since the UK left the EU following the end of the transition period on 31 December 2020.
The survey responses indicate that ROGS:
- continue to work well in terms of supporting a safe railway
- are meeting their original objectives
- have not led to any significant unintended consequences for businesses

Consultation description
We are seeking views and experiences of the ‘Railways and Other Guided Transport Systems (Safety) Regulations 2006’ (ROGS). These experiences will be used to make conclusions and recommendations for future improvement of the ROGS.
The review will address:
- the extent to which the regulations are achieving their intended effects
- whether there have been any unintended effects
- how well they are working and the reasons why
- if there are any areas for improvement
The Department for Transport has commissioned the Office of Rail and Road to undertake this review.
