This document sets out the government’s response to its consultation of 22 October 2013 on changes to the smart metering licence conditions. These changes included amendments to existing licence conditions concerning the domestic and non-domestic markets, and new licence conditions to implement EU Energy Efficiency Directive provisions on domestic consumer access to data from smart meters.
The legal drafting implements the extension of the completion date for the smart metering roll-out from 31 December 2019 to 31 December 2020 and consequential changes stemming from this. Changes will also be made to conditions governing the non-domestic market to reflect policy decisions following the “open letter” consultation of July 2013. A number of minor clarificatory and definitional changes will also be made.
The government also sets out new licence conditions implementing provisions of the Energy Efficiency Directive (2012/27/EC) that deal with domestic consumer access to consumption and export data. The licence conditions enable domestic consumers with a smart meter to have access to at least 24 months of daily/weekly/monthly/annual consumption data. The licence conditions will also provide domestic consumers with rights of access to their electricity export data.

The licence condition modifications will be laid in Parliament and, following successful completion of the Parliamentary process, will come into force in two stages. Those associated with chapters 3 and 4 of this document will come into effect on 6 April 2014 (except for the requirements on availability of consumption data to smaller non-domestic consumers which will come into effect on 4 June 2014), while those associated with chapter 5 of this document (the new Energy Efficiency licence conditions) will come into effect on 4 June 2014.

Consultation description
The government is seeking views on a number of proposed changes to Supply Licence conditions, including amendments clarifying the policy position and amendments resulting from the change in the completion date for the smart metering roll-out from 31 December 2019 to 31 December 2020. This consultation is set out in Part 2 of this document, with the draft licence conditions that would give effect to these proposed changes set out in Annex 4 to Parts 1 and 2. This consultation has two closing dates: section (i) closes on 19 November 2013; and sections (ii) and (iii) close on 3 December 2013.
