The Pension Schemes Act 2021 (“the Act”) gained Royal Assent on 11 February 2021. Part 3 of the Act relates to new powers for The Pensions Regulator and contains various provisions to make associated regulations.
A consultation was conducted seeking views on the proposed drafting of the 2 sets of draft regulations: The Pensions Regulator (Contribution Notices) (Amendment) Regulations 2021 (now referred to as The Pensions Regulator (Employer Resources Test) Regulations 2021) and The Pensions Regulator (Information Gathering Powers and Miscellaneous Amendments) Regulations 2021 (now referred to as The Pensions Regulator (Information Gathering Powers and Modification) Regulations 2021).

Consultation description
The purpose of this consultation is to draw interested parties’ attention to the proposed draft regulations on:
- The Pensions Regulator (Contribution Notices) (Amendment) Regulations 2021 which outline the ‘employer resources test’
- The Pensions Regulator (Information Gathering Powers and Miscellaneous Amendments) Regulations 2021
We welcome views on any impacts, including any unintended consequences that the draft regulations might have on specific groups. These regulations are expected to come into force in October 2021.
