The government hosted a public consultation from 7 August to 18 September 2023 on changes to regulations 3A, 19 and 247A of the Human Medicines Regulations 2012 to support the ongoing delivery of COVID-19 and influenza vaccination.
The consultation received 220 responses, with significant support for each proposal.
The consultation response provides analysis of the responses received and sets out the government’s intention to make amendments to the regulations.
‘Annex A: public sector equality duty’ considers any potential impacts of the amended regulations on those with protected characteristics.

Consultation description
The Human Medicines Regulations were amended by The Human Medicines (Coronavirus and Influenza) (Amendment) Regulations 2020 to provide greater flexibilities for the movement and supply of certain type of vaccines, in light of the COVID-19 pandemic.
The Department of Health and Social Care is looking to ensure that the flexibilities established by those regulations are maintained for a further time-limited period to support the continuing supply, distribution and administration of COVID-19 and influenza vaccines as we transition out of the pandemic. Specifically, we are interested in the following provisions:
- regulation 3A
- regulation 19
- regulation 247A
