In light of the response to this consultation and subject to the approval of all 4 legislatures, we will proceed with amending the 2020 Order with the 2 proposed SIs:

  • The Greenhouse Gas Emissions Trading Scheme (Amendment) Order 2021
  • The Greenhouse Gas Emissions Trading Scheme (Amendment) Order 2022

The second SI was previously referred to as Greenhouse Gas Emissions Trading Scheme (Amendment) (No. 2) Order 2021.

We have included a small number of further scheme improvements, following targeted consultation with affected parties.

We expect both SIs to be in force no later than 31 March 2022.

We received 7 responses that largely do not impact the policy intent of the proposed draft provisions.

This consultation sets out the UK government and devolved administration proposed technical amendments to the UK ETS legislation, which is accompanied by 2 draft Statutory Instruments.

This consultation is of particular interest to:

  • individual companies
  • representatives of industrial, power and aviation sectors with obligations under the UK ETS
  • environmental groups

This consultation is not limited to these stakeholders. Any organisation or individual is welcome to respond.
