Crime news: changes to cracked trial graduated fees for advocates go live

Changes to cracked trial graduated fee introduced for advocates in elected either way cases.

We would like to remind you that legislation was introduced on 2 October 2014 for changes to cracked trial graduated fees for advocates in elected either way cases.

This concerns cases which were deemed suitable for summary trial but the defendant elected for it to be heard in the Crown Court.

A graduated fee will be payable instead of a fixed fee where such cases crack because the:

  • prosecution offer no evidence on all counts against a defendant
  • judge directs that a verdict be entered

In such cases, a cracked trial graduated fee will be payable.
