The CMA has received several requests under the Freedom of Information Act (FOIA) about a document related to the Competition Commission’s examination of a proposed merger in the water industry in 2002.

This document is the partially redacted dissenting opinion provided by one of the members of the Commission that considered the merger.

The merger went ahead in 2003 but in a substantially different form to that originally considered by the Competition Commission. We consider that it is in the public interest that the document is now disclosed in full.
