In February 2024, a member of the public and Perrigo Company Plc complained about an advertisement to the general public for Cialis Together (tadalafil, a medicine with P [Pharmacy] legal status indicated for erectile dysfunction) produced as a shelf tray seen at 2 Well Pharmacy premises in the Stoke-on-Trent area between July 2023 and February 2024. The complainants alleged that the shelf tray inappropriately promoted the above medicine as being better than another named, identifiable over-the-counter (OTC) medicine.

MHRA upheld the complaint based on the view that the advertisement was in breach of regulation 287 (1b) of the Human Medicines Regulations 2012, which states that a person may not publish an advertisement relating to a medicinal product that suggests that the effects of taking the medicinal product… are better than or equivalent to those of another identifiable treatment or medicinal product. This prohibition is strongly supported by specific guidance in the Consumer Code published by the Proprietary Association of Great Britain.

Bestway Panacea Holdings Ltd t/a Wells Pharmacy confirmed that they have withdrawn the advertisement from use and that the claim in question would not be used in any future promotional material.
