Since the text of the Trade and Cooperation Agreement was agreed in December 2020, it has undergone a final process of legal revision in accordance with Article FINPROV.9 (now Article 780), and the version published below represents the version agreed in December, prior to this process. The substance of the Agreement has not changed; however, typographical and other errors have been corrected and the Articles have been renumbered from Article 1 – 783. Please see the final version of the agreement, following the outcome of the legal revision process, here.

The European Union (Future Relationship) Act 2020 (“the Act”) contains references to parts of the Trade and Cooperation Agreement that have now been updated as part of the process of legal revision, such as the article numbers of that Agreement. This does not change how the Act functions in practice and its substance should continue to be interpreted in the way that it has been to date. The references to the Agreement in the Act will be updated via secondary legislation in due course to reflect the new numbering in the Agreement.

Details

The United Kingdom and the European Union have agreed a Trade and Cooperation Agreement, an Agreement on Nuclear Cooperation and an Agreement on Security Procedures for Exchanging and Protecting Classified Information. These Agreements are designed to honour the instruction of the British people – expressed in the referendum of 2016 and the general election last year – to take back control of our laws, borders, money, trade and fisheries. It changes the basis of our relationship with our European neighbours from EU law to free trade and friendly cooperation.

  1. Replaced draft decision with final Decision of the UK-EU Partnership Council extending provisional application of the UK-EU Trade and Cooperation Agreement.

  3. As part of an analytical review of the figures describing the TCA fisheries outcomes, a small number of changes have been made to the summary explainer, to ensure that the estimated value of the UK’s negotiated quota uplift is described as clearly as possible.

  4. In response to stakeholder feedback, a number of minor drafting changes have been made to the summary explainer in relation to the Fisheries Heading. These are stylistic rather than substantive changes to ensure the effect of the agreed provisions is explained as clearly as possible.

  5. Adding: Exchange of letters between the United Kingdom and the European Atomic Energy Community on provisional application of the Agreement for Cooperation on the Safe and Peaceful Uses of Nuclear Energy: 30 December 2020

  6. This updated version of the treaty replaces the one published on 26 December. The only change is to correct an error in the name of one Member State.
