Egg Marketing Inspectorate privacy notice

This privacy notice explains why your personal data is collected when you register your premises. There is a legislative requirement for a customer to register their premises with the Animal and Plant Health Agency (APHA) if they are any of the following:
- egg production site
- egg packing centre
- egg wholesaler
- hatchery or breeding site
- a premises that will sell eggs or chicks

Who collects your personal data
Department for Environment, Food and Rural Affairs (Defra) acting through APHA, which is an Executive Agency of Defra, is the controller for the personal data that is collected by APHA:

The Welsh Government has commissioned APHA to deliver, monitor and enforce certain services, including the EMI. Where these services process personal data, the Welsh Government and APHA are joint controllers.
What personal data we collect and how it is used
There is a legislative requirement for all types of customers, to be subject to a defined, risk-based inspection scheme that is carried out by the APHA as the Competent Authority. This means personal data must be processed at all stages, from registration through to inspection outcomes, by the EMI to meet these legislative requirements.
Registration of an egg production site(s)
The following data will be processed:
- your name
- your contact details
- CPH (County Parish Holding) number of your livestock premises
- details of land used on a temporary basis
- details of your chosen veterinary practice
- landowner’s name and CPH number for the above
- location of your poultry premises including land areas, where applicable
- name, address and contact details of your customers
- name, address, and contact details of your supplier(s)
- name, address, and contact details of your transport supplier(s)
- name, address, and telephone number of premises to which you wish registration to apply, where applicable
- number and production type of poultry kept
- owner name, address and contact details, if different to the applicant details
- registered keeper name, address and contact details of the appointed named responsible person, if not you, as applicable
Registration of an egg packing centre
The following data will be processed:
- your name
- your contact details
- name, address, and contact details of your supplier(s)
- name, address, and contact details of your transport supplier(s)
- name, address, and telephone number of premises to which you wish registration to apply, where applicable
Registration of a hatchery, poultry breeding establishment or pedigree breeding establishment
The following data will be processed:
- your name
- your contact details
- CPH number of your livestock premises
- name, address, and telephone number of premises to which you wish registration to apply, where applicable
- number and production type of poultry kept
Registration of an egg wholesaler establishment
The following data will be processed:
- your name
- your contact details
Registration of an egg collector, egg boiling plant and egg processors
The following data will be processed:
- your name
- your contact details
- name, address and contact details of your customers
- name, address, and contact details of your supplier(s)
The lawful basis for processing your personal data
The lawful bases for processing your personal data are public task and legal obligation, as required by:

- The Control of Salmonella in Poultry Order 2007 (legislation.gov.uk)

- The Eggs and Chicks (England) Regulations 2009 (legislation.gov.uk)
- The Eggs and Chicks (Wales) Regulations 2010 (legislation.gov.uk)
- The Food Hygiene (Wales) Regulations 2006
- The Food Safety and Hygiene (England) Regulations 2013
This legislation requires that APHA, on behalf of the Defra Secretary of State and the Welsh Government Cabinet Secretary respectively, creates and maintains a register of establishments, issuing the relevant distinguishing numbers to those establishments. The legislation also requires that APHA inspect all registered premises, including inspecting and taking copies, where required, of associated documents and records which may contain personal data for the purposes of ensuring that the provisions of the relevant pieces of legislation are being complied with.
Regulation 18 of the respective 2009 and 2010 Eggs and Chicks regulations requires the sharing of any information between APHA and any other Food Authority to allow them to perform their duties.
Consent to process your personal data
The processing of your personal data is not based on consent. You cannot withdraw it.
Who we share your personal data with
APHA will share the personal data collected under this privacy notice with the following organisations under one or more of the legislation listed above.
APHA respects your personal privacy when responding to access to information requests. We only share information when necessary to meet the statutory requirements of the Environmental Information Regulations 2004 and the Freedom of Information Act 2000.
Food Standards Agency (FSA)
Inspections are completed in England and Wales by APHA on behalf of the FSA. They have access to the personal data for the purpose of monitoring compliance of egg quality when marketed for human consumption under the legislation.
Scottish Government and Food Standards Scotland (FSS)
APHA carries out monitoring compliance of egg quality when marketed for human consumption under the legislation on behalf of the Scottish Government. APHA provides reports on egg marketing compliance and delivery in Scotland.
Department of Agriculture, Environment and Rural Affairs (DAERA)
DAERA has access to the personal data for the purpose of monitoring compliance of egg quality when marketed for human consumption under the legislation.
Welsh Government
APHA carries out monitoring compliance of egg quality when marketed for human consumption under the legislation on behalf of the Welsh Government. APHA provides reports on egg marketing compliance and delivery in Wales.
Local Authorities
The Local Authorities have access to the personal data for the purpose of monitoring compliance of egg quality when marketed for human consumption under the legislation listed below. They also have access to the personal data to facilitate joined up working with regards to enforcement.
International auditors
Data will be shared with the audit team to assess traceability and UK legislative compliance, only during an international audit of the UK. This allows for continued trade between the UK and other countries under the WTO SPS (World Trade Organisation Sanitary and Phytosanitary Measures) Agreement.
How long we hold personal data
Your personal data will be held for a maximum of 7 years after deregistration from the Egg Marketing Inspectorate database.
What happens if you do not provide the personal data
If you do not provide the necessary personal data, APHA will be unable to process your application or register your business. This may prevent you from operating as a poultry or egg business.
Use of automated decision-making or profiling
The personal data you provide is not used for:
- automated decision making (making a decision by automated means without any human involvement)
- profiling (automated processing of personal data to evaluate certain things about an individual)
Transfer of your personal data outside of the UK
APHA will only transfer your personal data to another country that is deemed adequate for data protection purposes.
