Your personal information supplied for the purposes of The Clandestine Entrant Civil Penalty Accreditation Scheme, will be held and processed by the Home Office.

The Home Office collects and processes personal information to fulfil its legal and official statutory functions. We will only use personal information when the law allows us to and where it is necessary and proportionate to do so.

The Home Office is only allowed to process your data where there is a lawful basis for doing so. We have systems and policies in place to limit access to your information and prevent unauthorised disclosure. Staff who access personal information must have appropriate security clearance and a business need for accessing the information, and their activity is subject to audit and review.

The lawful basis for the processing of any personal data received in applications to join this scheme falls under the following:

Article 6(1)(e) General Data Protection Regulation The processing is necessary for the performance of a public task
Section 8  Data Protection Act 2018 Processing necessary for government functions

The information you provided in this application will be used to:

  • make a decision on an application to join the Civil Penalty Accreditation scheme including checking whether the information you have provided is correct
  • help prevent and detect crime e.g fraud or money laundering
  • help improve the service and train Home Office Staff
  • keep you informed about important developments and changes regarding the scheme
  • keep you updated regarding other border related developments (if you choose to opt into this service by selecting the relevant box on the application form)

The Home Office may share your information with other organisations while carrying out our functions, or to enable others to perform theirs.

Processing and Profiling

The data provided will not be used for automated decision making or profiling. 

Storing your information

Your personal information will be held for as long as necessary for the purpose for which it is being processed and in line with departmental retention policy. More details of this policy can be found at Home Office retention and disposal standards - GOV.UK (www.gov.uk).

Sources and categories of information

To demonstrate meeting the requirements of the scheme, those applying to join the scheme, must supply evidence.  This includes evidence of completed checklists and training details and instructions issued to drivers to effectively secure vehicles and prevent clandestine entrants. 

Personal data may therefore be supplied by the applicant to the scheme and will not be supplied by the individual directly e.g a haulier applies to join the scheme and submits evidence of training and checklist requirements and those documents contain the personal details of drivers. 

The details that are often included with these documents include names of drivers and potentially their address and nationality.  

Additionally, the application seeks a named representative from the company along with their company email address. 

No special category data is likely to be supplied with any application.  

Requesting access to your personal data
