Apply for a non-molestation or occupation order
You can use this form to apply for:
- a non-molestation order to protect you or a child from abuse or harassment, or to stop someone coming to or near your home
- an occupation order to ask the court to decide who should live in or return to your home or any part of your home
These orders are types of injunctions. Depending on your situation, you can apply for one of these orders, or both.
There are no court fees for applying.
If the person you need protection from lives in Greater Manchester, Croydon, Bromley or Sutton, you can apply for a domestic abuse protection order instead.
Complete a supporting witness statement
You must also complete a supporting witness statement.
The template helps you to provide the information needed by the court.
You do not need to use the template if you would prefer to write your own statement. However, you must read the guidance in the template.
If you choose to write your own supporting witness statement, it must include the following statement of truth, your signature and the date:
I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth. I believe that the facts stated in this form and any continuation sheets are true.
