How to stop a grant of probate by post

Who can apply
You can apply to stop a probate application (also known as ‘enter a caveat’) if, for example, you have a dispute about:
- who can apply for probate
- whether a will exists
You can apply if you’re aged 18 and over and:
- an executor named in a will
- an interested party
- a probate practitioner (such as a solicitor)
Fee
It costs £3 to stop an application for 6 months.
How to apply
You can apply online to stop a probate application.
If you’re an executor named in a will or an interested party, you can also apply by post.
If you’re a probate practitioner, you can also apply by post or email.
You can apply to stop the probate application before or after the application is received.
If successful, you’ll get a ‘caveat’ – a stop to the grant of probate from being issued, which lasts for 6 months.

Pay the £3 application fee by sending a cheque payable to ‘HM Courts and Tribunals Service’ with your form.
