Details
If a request for information and consultation arrangements is made by fewer than 40% of employees, and there is a pre-existing agreement, the employer can hold a ballot to determine whether employees endorse the request. There are 3 complaints that can be made about the ballot:
- Has the employee informed the employees, within 1 month of the request, that it intends to hold a ballot?
- If the employer has informed the employees that it intends to hold a ballot, has the ballot been arranged or has it taken place prematurely?
-
If the ballot has taken place, did it comply with the Regulations which state:
- the ballot must be fair
- all employees must be entitled to vote
- voting is in secret
- votes are accurately counted
Use the form which is appropriate to your complaint under the Information and Consultation of Employees Regulations 2004.
If you are an employer, the CAC will ask you to respond to any complaint.
