The Botulinum Toxin and Cosmetic Fillers (Children) Act grant determination 2022 to 2023

Background

In October 2021, the Botulinum Toxin and Cosmetic Fillers (Children) Act came into force.

The main purpose of the act is to prohibit the administering of botulinum toxin, or a filler by way of injection for a cosmetic purpose, to a person under 18 in England. It will also be an offence to make arrangements to undertake, or arrange for another person to undertake, these procedures on a person under 18 in England.

There is guidance to support local authorities and the police in successfully implementing the legislation .

In 2022 to 2023 the total Botulinum Toxin and Cosmetic Fillers (Children) Act grant to local authorities will be £1,465,699. The grant will support local authorities in England with expenditure lawfully incurred or to be incurred because of the Botulinum Toxin and Cosmetic Fillers (Children) Act 2021.

The grant

The Secretary of State has determined, pursuant to section 31 of the Local Government Act 2003, to pay grants to relevant authorities in the amounts indicated for the financial year 2022 to 2023.

The grant allocations have been determined via the public health grant funding methodology. Through the public health grant model, the government Department of Health and Social Care (DHSC) pays 152 upper tier local authorities each year through section 31 of the Local Government Act (2003).

The grant for 2022 to 2023 includes an adjustment to cover familiarisation and training costs. The distribution of this funding can be found on a spreadsheet with this circular.

Annex A: The Botulinum Toxin and Cosmetic Fillers (Children) Act grant determination 2022 to 2023: number 31/6164

The Parliamentary Under Secretary of State (Minister for Patient Safety and Primary Care) (‘the Minister of State’), in exercise of the powers conferred by section 31 of the Local Government Act 2003, makes the following determination:

Citation

1) This determination may be cited as The Botulinum Toxin and Cosmetic Fillers Children Act Grant Determination 2022 to 2023 [No31/6164].

Purpose of the grant

2) The purpose of the grant is to provide support to local authorities in England towards expenditure lawfully incurred or to be incurred by them.

Determination

3) The Minister of State determines as the authorities to which grant is to be paid and the amount of grant to be paid, the authorities and the amounts set out in Annex B.

4) Before making this determination in relation to local authorities in England, the Minister of State obtained the consent of the Treasury.
