Details

The claimant alleged a breach of rule relating to the eligibility of Mr Kenny, the union’s general secretary, for election to office based on his membership of the union’s pension scheme. Following correspondence with the parties the Assistant Certification Officer, using his powers under section 256ZA of the 1992 Act, struck out the complaint on the grounds that it had no reasonable prospect of success and was otherwise misconceived.
