Details

The claimant alleged that the union had failed to follow the procedures set out in a National Agreement for the Engineering Construction Industry and that that agreement was part of the rules of the union. Following correspondence with the claimant the Certification Officer, using his powers under section 256ZA of the 1992 Act, struck out the complaint on the grounds that it had no reasonable prospect of success or was otherwise misconceived.
