This regulatory position statement (RPS) does not change your legal requirement to have an environmental permit for a waste operation when you treat diluted non-hazardous pesticide washings using lined biobeds or above ground biofilters if the treatment site is within either:

a groundwater source protection zone 1 (SPZ1)

250 metres of a borehole used to supply water for domestic or food production purposes
However, the Environment Agency will not normally take enforcement action if you do not comply with this legal requirement if you meet the requirements in the RPS.
The regulatory position does not apply to any other legal requirements.

We have updated this RPS to include biofilters and used the latest RPS template. The next review date is 30 June 2027.

Extended the review date to October 2024.

The Environment Agency has amended the review date of this RPS to August 2021. Operators must now provide information about operational and maintenance procedures of the proposed biobed.
